NES Fircroft are working with our valued client who are looking for a Senior Contracts Specialist to join their Perth Office on an initial 6 month contract. 

Position Purpose:

The commercial interests of the Company in respect of the projects and tenders are satisfactorily projected in all its activities and transactions with clients or third parties, in particular:
  • Commercial opportunities are pursued and maximised
  • Contractual risks are accurately identified, communicated to internal stakeholders and mitigated
  • Company rights and entitlements are protected
  • Company policies and procedures are adhered to
  • Project reports accurately reflect the current commercial status of the project and the likely outcome at completion
Main Accountabilities
  • Provide guidance to the project team to ensure adherence to the requirements of the main contract and preserve company rights and entitlements.
  • Provide proactive contractual/commercial leadership, stakeholder management and the main contract administration to deliver project objectives, KPIs and commercial value outcomes.
  • Prepare flow downs from the main contract to be incorporated into the subcontracts and PO terms and conditions
  • Ensuring that all notifications to the client are issued within the timeframe and in the format set out in the main contract.
  • Preparation, issue, negotiation and settlement of claims and variations to the client, working in collaboration with the Project Manager, Contracts Manager, Cost Control and Legal department as necessary.
  • Preparation of progress claims in conjunction with the PCM/Cost Controller and the PMT, and negotiation and agreement with client’s representatives of the amounts claimed.
  • Supporting and monitoring of effective Management of Change process
  • Variation Request and an extension of time management in full compliance with the main contract requirements.
  • Pursue and maximise any commercial opportunities to reduce project cost, maximise efficiencies and improve profit margins.
  • Insurance certificates are issued to the client in compliance with the terms and conditions of the contract and the requirements set out in “Group Contracting Principles”
  • Agreement of terms of Performance and Retention Guarantees in accordance with the requirements of the main contract.
  • Preparation and negotiation of final account with client representatives.
  • Aiding the Project Manager to produce the Project Execution Plan with respect to the main contract key provisions, including a detailed main contract management plan if required.
  • If required, preparation and presentation of a slide pack summarising the main contract rights and obligations, risks and opportunities and liabilities and indemnities.
  • Monitoring and updating the main contract management plan to ensure compliance with the requirements of the main contract.
  • Provide assistance with the submission of “Invitation to Tender” packages to prospective clients in conjunction with the relevant departments (i.e. Estimating/Tendering, Legal, Finance and Engineering).
  • Assist with forecasting of cost to project completion and final project revenue
  • Providing relevant input into Project Management Reports and other management reports as required by Senior Management
  • Facilitate internal and external Risk Workshops and maintain the Project Risk register.
  • Maintain awareness of, and compliance with, the Management System procedures in relation to the main contract
  • Where necessary, assisting Purchasing/Procurement and Subcontracting team with the negotiation of PO/subcontracts terms and conditions.
  • Where necessary, assisting the Purchasing/Procurement and Subcontracting team with the negotiation and settlement of claims and dispute resolution
  • Other duties to support the Subcontracting Department as required
Skills and experience
Qualifications
  • Bachelor’s degree in quantity surveying, law, engineering, commerce or construction management
Knowledge /Skills
  • A strong understanding of the principles of contracts law and business ethics and the contractual/commercial principles adopted with the industry
  • Proven commitment and experience to drive commercial and contractual management of change diligence, discipline and delivery.
  • Proven ability to drive commercial and contractual acumen and value outcomes end to end from tender, award and execution.
  • Excellent negotiation, verbal & written communication skills
  • Good personal and business organisation skills
  • Good knowledge
Experience
  • Minimum 10 years relevant experience in the same or similar role within the oil and gas or energy sectors.
