Privacy Policy for NESF Time App

This Privacy Policy refers to use of the NESF Time Application (“App”) and describes how NES Fircroft, on behalf of the NES Group businesses collect, use and disclosure information when you use the App and provides you with information on your privacy rights.

By accessing or using our App, you agree to the terms of this Privacy Policy. If you do not agree with the Policy, please do not use the App.


DEFINITIONS

For the purposes of this Privacy Policy the following definitions shall have the same meaning regardless of whether they appear singular or plural.

  • Account means a unique account created for you to access our service or parts of our service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application refers to NESF Time, the software program provided by the NES Fircroft.
  • Country refers to the United Kingdom.
  • Device means any device that can access the service such as a computer, a mobile phone or a digital tablet.
  • Personal Data means any form of data which relates to a living individual who can be identified from it directly or indirectly. Also referred to as Personally Identifiable Information (PII), or Personal Information (PI).
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the NES Fircroft. It refers to third-party companies or individuals employed by us to facilitate the Service, to provide the Service on our behalf, to perform services related to the Service or to assist us in analysing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You are the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.  Also referred to as the ‘data subject’.


TYPES OF DATA COLLECTED

Personal Data

While using our service, we may ask you to provide us with certain personal data that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Email address.
  • First name and last name.
  • Usage Data.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile internet browser you use, unique device identifiers and other diagnostic data.

We may also collect information that your browser sends whenever you visit our service or when you access the service by or through a mobile device.

Information Collected while Using the Application

While using our App, in order to provide features of the App, we may collect, with your prior permission:

  • Pictures and other information from your Device's camera and photo library. This may include images or expenses, invoices and/or receipts as supporting documentation linked to your working hours.

NES Fircroft process this Personal Data to provide services of the App, maintain our records, and meet our obligations as a staffing solutions partner.  The information provided is uploaded to the company's servers and/or a service provider's server in order to provide the services associated with the App.

You can enable or disable access to this information at any time, through Your Device settings.


USE OF YOUR PERSONAL DATA

NES Fircroft process your Personal Data for the following purposes:

  • To provide services of the App, including monitoring usage of our services.
  • To manage your account and/or registration as a user of this App.
  • To process and approve time and/or invoices associated with your working hours, including supporting documentation to support working hours.
  • To maintain our records and meet our obligations as a staffing solutions partner.  
  • To contact you by email, telephone, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide you with news and general information about our services, the App unless you have opted not to receive such information.
  • To manage your requests to us associated with the service or the App.
  • For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our service, products, services, marketing and your experience.


We may share Your personal information in the following situations:

  • With Service Providers to monitor and analyse the use of our Service, to contact you.
  • For business transfers in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
  • With business partners to offer you certain products, services or promotions.
  • With other users when you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With your consent we may disclose your personal information for any other purpose with your consent.


RETENTION OF DATA

Personal data collected during the use of the App will only be kept for as long as NES Fircroft has a genuine business need for it or are required to keep it by law, whichever is longer.  This includes any supporting documents provided through the App.  Information provided whilst using the App, retained in line with financial retention periods.

Any Personal Data about you are retained in line with our document management practices, with controls and security applied on access and location.


TRANSFER OF YOUR PERSONAL DATA

Your information, including Personal Data, is processed within our operating system and may be may be transferred and processed, for the purposes defined within this Privacy Policy, to a system located outside of the jurisdiction in which you reside or in jurisdiction where the data protection laws may differ than those from your jurisdiction. The purpose of approving submissions made by you through the App, information may also made be transferred to international client organisations.

NES Fircroft has appropriate controls in place designed to protect your Personal Data and privacy when information is transferred to internal systems or international organisations.

Your agreement to this Privacy Policy followed by submission of information as part of the NESF Time App represents your agreement to that transfer.


DELETING YOUR PERSONAL DATA

NES Fircroft respect the information that you share with us and understands it is your right to know how this data is processed and exercise your right to ask us to stop processing it, including where aligned with legal obligations, to delete or assist in the deletion of your personal data.

Our Service may give you the ability to delete certain information about you from within the service.

You may update, amend, or delete your information at any time by signing in to your account, if you have one, and visiting the account settings section that allows you to manage your personal information. You may also contact us to request access to, correct, or delete any personal information that you have provided to us.

Further information and advice about your rights can be obtained from the data protection Regulator in your Country or residence.


DISCLOSURE OF YOUR PERSONAL DATA

In certain circumstances Personal Data may be disclosed to assist in the prevention and detection of crime and for law enforcement purposes without the consent of the individual concerned. Under these circumstances NES Fircroft will use reasonable endeavours to check the request is legitimate before disclosing requested data and in all cases shall first seek authorisation through NES Fircroft’s Data Protection Advisory Team and/or relevant Directors of the business.

If NES Fircroft is involved in any transactional process regarding its ownership your Personal Data may be disclosed subject to strict confidentiality obligations and anonymisation where possible.  

We may transfer your personal data to a third party as part of a sale of business assets or as part of any business restructuring or reorganisation, however we will always take steps to ensure that your privacy and rights continue to be protected.


SECURITY OF YOUR PERSONAL DATA

The security of your Personal Data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security, however we shall ensure that we apply appropriate technical and security measures to maintain the confidentiality, integrity and availability of data held on our systems, within data centres controlled by us, and as part of our service provision to you.


CHILDREN'S PRIVACY

Our Service does not address anyone under the age of 13. We do not knowingly collect Personal Data from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us immediately at dpat@nesfircroft.com

If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.
