Description
  • Position owns the development, execution and implementation of Contracting Strategies for a portfolio of Turnaround services contracts.
  • Develop and implement contracting strategies to maximize commercial value
  • Ensure contracts are effectively implemented & applied to maximize benefit
  • The position will interface with procurement, technical /operations resources, and Contractor commercial / management teams. 
  • The incumbent will require good working knowledge of the Purchase to Pay process and of the relevant technical work scopes.
  • The incumbent will possess strong commercial & interpersonal skills to influence & interact effectively with key interfaces, to drive innovative contracting strategies and to support the Business Line Contract Owner maximize the commercial benefits during contract execution.

Major Responsibilities
  • Own the Contracting Strategy for a portfolio of contract services
  • Identify and drive opportunities for change & improvement (contracting strategies, contract scope & structure, contract application & adherence)
  • Ensure Procurement Plans for contract tender/renewals (PIP) are aligned with contracting strategies, business objectives and site priorities
  • Input, review & validate quarterly update of Procurement PIP document
  • Act as focal point of contact to Procurement throughout contract lifecycle, specifically during tender preparation, negotiations, and contract implementation
  • Develop tender and implementation plan for all contracting/tender activities (including deliverables, owners & timeline/milestones)
  • Identify & engage appropriate stakeholders to support the tender and contract implementation activity (eg. development of RFQ packages and contract documents, qualification of bidders)
  • Review/Propose bid lists & Coordinate operational qualification of suppliers
  • Create / review tender documents, with emphasis on technical work scopes and commercial (measurement & payment) exhibits
  • Ensure contract documents are well structured and clearly define all work requirements & contractor obligations (to avoid interpretation issues /disputes after contract award)
  • Update technical work scopes and transaction processing sections to apply lessons learned / improvement opportunities to base on experience of the previous contract
  • Create bid check estimates and coordinate technical input to calculate soft money factors
  • Participate / support negotiations for key contracts
  • Lead the management of change for implementation of new site contracts
  • Develop MOC documentation and obtain necessary endorsements
  • Develop materials for Kick Off Meeting, including summary of key contract items, method of measurement, in-out list, roles and responsibilities
  • Coordinate and host Contract Kick Meeting to establish joint user/supplier understanding of key requirements, roles & responsibilities.
  • Develop and deliver supplemental training for agreement owners
  • Coordinate with the company and Contractor’s Planning & SES groups to ensure process and control points are defined (requisitioning, URPF & service master details, MCR process, user approvers, price checking of “points lines”) and system ids are implemented 
  • Provide ongoing commercial support during contract lifecycle
  • Identify need for amendments and expedite implementation by procurement
  • Clarify the applicability & interpretation of contract terms to resolve adhoc issues (eg requests for extra payment outside unit rates)
  • Carry out analytical support to expedite resolution of claims
  • Apply KPI metrics to generate materials for Contractor Performance Appraisal meetings
  • Proactively support the Business Line Contract Owner to lead SRM Performance reviews; revise performance objectives / establish improvement plans as appropriate.
  • Drive continual improvement and innovation initiatives: Set and steward TOT and MEV targets, and manage contractor to deliver against targets
  • Review results of field checks, defining and leading necessary follow-up actions to close out issues. (eg. controls, leakage, measurement)
  • In collaboration with Support Group, understand transaction efficiency issues (eg WIP) and related controls for agreement portfolio. Lead contractor-specific improvement plans where required.
  • Promote improvement through collaboration:  Networking & Peer Assists 
  • Support external site benchmarking & peer assists
  • Network with Contract Engineer peers, transaction group, and agreement owners/users to capture improvement opportunities
  • Disseminate & apply expertise and “lessons learned” across the network to continuously improve contract efficacy and optimize transaction efficiency (eg at strategy development; tender preparation; contract implementation phases)
  • Maintain core procedures & documentation within Commercial Group Eg Contract Work Coordination Procedures

Position Dimensions
  • The scope of a contract portfolio for any individual Contract Engineer will be determined primarily by business objectives and site requirements, but will take into account the incumbent’s level of experience & knowledge of specific trades. 
  • All incumbents will be responsible for a portfolio which includes contracts of varying degrees of criticality/complexity, and of different trades. 
  • As far as business requirements permit, portfolios will be aligned to leverage specific trade / technical knowledge and as appropriate for the incumbent’s experience level.
